Terms of Service

These Terms of Service ('Terms') govern your access to and use of the YBuffet platform, including ybuffet.com, our mobile applications, and related services (collectively, the 'Platform') operated by YBuffet Inc. ('YBuffet,' 'we,' 'us,' or 'our'). By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
These Terms apply globally. Users in specific jurisdictions (EU/EEA, UK, Australia, Canada, and others) have additional rights under Appendix B (Jurisdiction-Specific Terms) that supplement or, where legally required, take precedence over the general terms below.
1. Eligibility
You must be at least 18 years old to use the Platform. By using the Platform, you represent that you are 18 or older and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
2. Account Registration
To access most features of the Platform, you must create an account. You agree to:
Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Keep your password secure and not share it with others
Notify us immediately at grow@ybuffet.com if you suspect unauthorized use of your account
Be responsible for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that contain false information or that violate these Terms.
3. Platform Use and Acceptable Conduct
You agree to use the Platform only for lawful purposes and in accordance with our Community Guidelines. You may not:
Use the Platform to violate any applicable law or regulation
Post or transmit content that is false, misleading, defamatory, obscene, or harmful
Attempt to gain unauthorized access to any part of the Platform or other users' accounts
Use automated tools, bots, or scrapers to access the Platform without our written permission
Circumvent or interfere with any security, fee, or access controls on the Platform
Create multiple accounts to circumvent enforcement actions or manipulate the Platform
Engage in any conduct that interferes with other users' use or enjoyment of the Platform
4. Service Marketplace
YBuffet provides a marketplace that connects builders with service providers. We are not a party to any transaction between users. YBuffet does not:
Employ, endorse, or vouch for any service provider or their services
Guarantee the quality, safety, legality, or delivery of any service listed on the Platform
Verify the credentials, licenses, or qualifications of any service provider unless explicitly stated
Mediate disputes between users, except as described in our dispute resolution process
Users transact at their own risk. We strongly encourage you to review ratings, reviews, and provider profiles carefully before engaging services.
5. Payments and Fees
Transactions on the Platform are processed through our third-party payment processor. By making or receiving a payment through the Platform:
You agree to the payment processor's terms and conditions
You authorize the applicable charges to your chosen payment method
You understand that YBuffet may charge platform fees as disclosed at the time of transaction
You agree that all fees are non-refundable except as expressly provided in our refund policy or required by law
YBuffet is not responsible for payment processor errors, failures, or delays. Any disputes regarding charges must be raised within 60 days of the transaction date.
6. User Content
You retain ownership of content you post on the Platform. By posting content, you grant YBuffet a license as described in our User Content License. You are solely responsible for your content and represent that:
You own or have the right to post the content
The content does not violate any third-party rights or applicable law
The content complies with our Community Guidelines
We reserve the right to remove content that violates these Terms or our Community Guidelines without notice.
7. Intellectual Property
YBuffet and its licensors own all rights in the Platform, including the design, code, trademarks, and content created by YBuffet. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our written permission. See our IP Policy for full details.
8. Privacy
Our Privacy Policy explains how we collect and use your personal information globally. By using the Platform, you agree to our Privacy Policy. EU/EEA/UK users should also review our EU/Global Privacy Addendum.
9. Third-Party Services and Links
The Platform may contain links to third-party websites or integrate third-party services. We are not responsible for the content, privacy practices, or terms of any third party. Your use of third-party services is at your own risk and subject to their terms.
10. Disclaimers
THE PLATFORM IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT ENDORSE ANY USER, SERVICE PROVIDER, PRODUCT, OR SERVICE ON THE PLATFORM.
Consumers in jurisdictions with mandatory statutory warranties (including Australia under the Australian Consumer Law, and the UK under the Consumer Rights Act 2015) retain those statutory rights regardless of the above disclaimer. Nothing in these Terms excludes or limits statutory rights that cannot be waived by contract.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, YBUFFET AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.
IN NO EVENT SHALL YBUFFET'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE GREATER OF: (A) THE TOTAL FEES YOU PAID TO YBUFFET IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) FIVE HUNDRED DOLLARS ($500). THIS LIMITATION APPLIES REGARDLESS OF THE FORM OF ACTION OR THE BASIS OF THE CLAIM.
EU/EEA/UK/Australian consumers: nothing in this Limitation of Liability section excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under mandatory consumer protection law in your jurisdiction. Your statutory rights are not affected.
12. Indemnification
You agree to indemnify, defend, and hold harmless YBuffet and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your content; (c) your violation of these Terms; or (d) your violation of any third-party rights. This indemnification obligation does not apply to EU/EEA consumers to the extent prohibited by applicable consumer protection law.
13. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Informal Resolution
Before initiating any formal dispute, you agree to contact us at grow@ybuffet.com and attempt to resolve the dispute informally. We will try to resolve disputes within 30 days of receiving notice.
Binding Arbitration (US Users)
For users located in the United States: If informal resolution fails, any dispute arising from or related to these Terms or the Platform (except small claims court matters and IP disputes) will be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules. Arbitration will take place in San Francisco, California, or via videoconference. The arbitrator's decision is final and binding. You and YBuffet each waive the right to a jury trial.
Class Action Waiver (US Users): YOU AND YBUFFET AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
EU/EEA consumers: The binding arbitration clause and class action waiver in this Section do NOT apply to you. EU consumers may bring disputes before the courts of their member state of habitual residence. The European Commission's Online Dispute Resolution platform (ec.europa.eu/consumers/odr) is available for consumer disputes. Nothing in these Terms prevents you from bringing a dispute before your local courts.
UK consumers: The binding arbitration clause and class action waiver do NOT apply to you. You may bring disputes before UK courts.
Australian consumers: The binding arbitration clause and class action waiver do NOT apply to mandatory consumer protection disputes under the Australian Consumer Law.
Canadian consumers: Mandatory provincial consumer protection laws may limit the applicability of the arbitration clause in your province. Quebec consumers in particular retain the right to bring disputes before Quebec courts.
Brazilian consumers: Under the Brazilian Consumer Protection Code (CDC), mandatory consumer rights cannot be waived by contract. Brazilian consumers retain all rights under the CDC.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of California, USA, without regard to its conflict of law principles.
Mandatory local law: Notwithstanding the California governing law clause, where mandatory consumer protection laws of your country of residence provide greater protections, those laws will apply to the extent they cannot be excluded by contract. Specifically: EU/EEA consumers benefit from the mandatory consumer protection laws of their member state; UK consumers benefit from UK consumer protection laws; Australian consumers benefit from the Australian Consumer Law; Canadian consumers benefit from applicable provincial consumer protection laws; Brazilian consumers benefit from the Consumer Protection Code (CDC).
Subject to the arbitration agreement and jurisdiction carve-outs above, you consent to exclusive jurisdiction and venue in the state and federal courts located in San Francisco County, California.
15. Time Limitation on Claims
Any claim arising from or related to these Terms or your use of the Platform must be filed within three (3) years after the claim arose. Claims not filed within this period are permanently barred, to the fullest extent permitted by applicable law.
EU/EEA consumers: Your statutory limitation periods under the laws of your member state apply and may differ from the above.
16. Changes to These Terms
We may update these Terms from time to time. For material changes, we will provide at least 30 days notice by email or prominent notice on the Platform before the changes take effect. If you do not agree to the updated Terms, you may close your account before the effective date. Non-material changes may take effect immediately.
EU/EEA consumers: If we make material changes that adversely affect your rights, you have the right to terminate the contract within 14 days of notice without penalty.
17. Termination
We may suspend or terminate your account and access to the Platform at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our sole discretion. You may close your account at any time by contacting grow@ybuffet.com. Upon termination, your right to use the Platform ceases, but provisions that by their nature should survive termination (including Sections 10-15) will survive.
EU/EEA consumers: We will provide reasonable advance notice of termination where required by EU consumer law, except in cases of material breach or fraud.
18. Miscellaneous
Entire Agreement: These Terms, together with our Privacy Policy, Community Guidelines, and other applicable policies, constitute the entire agreement between you and YBuffet regarding the Platform
Severability: if any provision of these Terms is found unenforceable, the remaining provisions remain in full force
No Waiver: our failure to enforce any provision of these Terms is not a waiver of our right to do so later
Assignment: you may not assign your rights under these Terms without our written consent. We may assign our rights without restriction
Force Majeure: we are not liable for failures caused by circumstances beyond our reasonable control, including natural disasters, internet outages, or government actions
Language: In case of conflict between a translated version of these Terms and the English version, the English version prevails. For EU consumers, we will provide Terms in the official language of your member state upon request
Appendix B: Jurisdiction-Specific Consumer Rights
B1. EU/EEA Consumer Rights (EU Consumer Rights Directive 2011/83/EU)
Right of Withdrawal for Digital Services: If you are an EU consumer purchasing a subscription or digital service from YBuffet, you have a 14-day right of withdrawal from the contract without giving any reason, starting from the day the contract is concluded. To exercise this right, contact grow@ybuffet.com with a clear statement of your decision to withdraw.
Exception: If you have expressly requested that we begin providing the digital service during the 14-day withdrawal period, and the service has been fully performed, you may lose your right of withdrawal.
Refund on Withdrawal: If you withdraw within 14 days before any service performance begins, you will receive a full refund within 14 days of your withdrawal notice.
Conformity: Digital services and products must conform to the contract. EU consumers have statutory remedies if a digital service is not in conformity.
Online Dispute Resolution: The European Commission provides an Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. Our email for ODR purposes is grow@ybuffet.com.
B2. UK Consumer Rights
UK consumers are protected by the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You have a 14-day cancellation right for digital services not yet commenced. Your statutory rights under UK law are not affected by anything in these Terms.
B3. Australian Consumer Rights (Australian Consumer Law)
The Australian Consumer Law provides consumer guarantees for services that cannot be excluded. If services fail to meet a consumer guarantee, you are entitled to a remedy. Nothing in these Terms excludes, restricts, or modifies any right or remedy conferred by the Australian Consumer Law.
B4. Canadian Consumer Rights
Canadian consumers, including those in Quebec, Ontario, and British Columbia, have additional rights under provincial consumer protection legislation. These Terms do not limit any rights you have under applicable provincial law. For Quebec consumers, any disputes may be brought before the applicable Quebec consumer protection authority or courts.
